Canada Invokes 1977 Treat to Keep Enbridge’s Line 5 Operational in Wisconsin

To prevent the Line 5 pipeline in Wisconsin from being shut down, Canada has invoked a 1977 pipeline treaty with the United States. This is the second time the treaty has been invoked this year, which governs the free flow of oil between the two countries. The Bad River Band in Northern Wisconsin is seeking to shut down the pipe due to the risk of a leak and expired easements between Enbridge and the tribe.

Enbridge is actively pursuing re-routes for the pipeline around the Bad River Reservation, and there are concerns that a shutdown would disrupt energy flows in the region. For Enbridge, the pipeline is a core asset. It is a part of Enbridge's Mainline network, and alone the Line 5 pipeline delivers up to 540 Mbbl/
District Court Judge Issues Permanent Injunction Against Ban of Oil & Gas Leasing on Federal Lands & Waters

U.S. District Court Judge Terry Doughty has "ruled that Biden's executive order issued January 27, 2021, violated the Mineral Leasing Act (MLA) and Outer Continental Shelf Lands Act (OCSLA) and was "beyond the authority of the President of the United States. Even the President cannot make significant changes to the OCSLA and/or the MLA that Congress did not delegate." After some back and forth, Doughty issued a permanent injunction in a 43-page ruling. Additional states have joined Louisiana and Texas like Alabama, Alaska, Arkansas, Georgia, Mississippi, Missouri, Montana, Nebraska, Oklahoma, Utah, and West Virginia.

With the potential of the U.S. holding zero lease sales due to the President's rulings against additional land sales and subsequent new drilling, the country could be at an energy security risk. Halting lease sales hinder producers' ability to supply affordable, reliable energy to citizens. Because of this foreseeable consequence, some federal judges are siding with Texas and Louisiana Attorney Generals to enable oil and gas leasing and drilling permits in the country despite the President's attempts to stop them.
